1. Agreement to terms

By accessing or using Alchemy ("the Service"), operated by Archer & Rose Inc., a Canadian corporation registered in Alberta ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the service

Alchemy is an intelligent leadership development tool that uses psychometric data and conversational technology to facilitate reflective practice. The Service is not a substitute for professional psychological, medical, or legal advice.

3. Accounts and registration

You must register an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to create an account. You agree to provide accurate information during registration and to keep it up to date.

4. Subscriptions and billing

The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly through Paddle.com, our merchant of record. Paddle handles all payment processing, invoicing, tax collection, and compliance on our behalf.

By subscribing to a paid plan, you authorise Paddle to charge your chosen payment method on a recurring basis. You are committed to the Service for the duration of each billing period and no refunds are issued for that period. You may cancel your subscription at any time through your account dashboard. To ensure your cancellation is processed before the next renewal, you must cancel at least 5 days before the end of your current billing period. A reminder email will be sent before each renewal.

Pricing is listed in USD. Local currency equivalents and applicable taxes are calculated by Paddle at the time of purchase.

5. Free tier limitations

Free accounts are subject to usage limits including a maximum of 50 messages per month and 3 document uploads. These limits may change at our discretion with reasonable notice.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Attempt to extract, copy, or reconstruct the Service's underlying prompts, instructions, models, or operating logic, whether by direct request, automated probing, or any other means
  • Attempt to manipulate, override, or circumvent the Service's operating instructions, safety constraints, or intended behaviour
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload malicious files, content that infringes intellectual property, or content that violates the rights of others
  • Share account credentials with any other person. Alchemy is a deeply personal tool containing sensitive psychometric and reflective data. Sharing credentials exposes you to a serious invasion of privacy. If you wish to join profiles with another user, the Service provides a dedicated feature called Stitch, available on the Pro plan
  • Use automated tools to access the Service (bots, scrapers, etc.)

7. Intellectual property

The Service, its original content (excluding user-provided data), features, and functionality are owned by Archer & Rose Inc. and are protected by copyright and other intellectual property laws. Your data remains yours; see our Privacy Policy for details on how we handle it.

8. Generated content disclaimer

The Service uses technology to generate responses. Generated outputs are not professional advice and may occasionally be inaccurate or incomplete. You should not rely solely on generated content for important decisions. We disclaim all liability for actions taken based on generated content.

9. Data and privacy

Your use of the Service is also governed by our Privacy Policy. We encrypt sensitive personal data at rest and do not sell or share your data with third parties for marketing purposes.

10. Account termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account and all associated data at any time through the Service. Upon account deletion, your personal data is permanently and irreversibly removed.

11. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.
